We speak plainly here, but make no mistake: this is a strictly binding legal contract. By continuing to access ShakTide’s platform, participating in our ground events, or using our digital and AI tools, you explicitly agree to these Terms in their entirety. If you do not agree, you must exit this platform immediately.

We Are Not Your Doctor

This is our absolute, non-negotiable rule. ShakTide is an educational social startup. We are not a hospital, clinic, pharmacy, or licensed medical provider.

  • No Medical Advice: All content, workshop materials, research summaries, and outputs generated by our AI tools are strictly for informational and educational purposes only.
  • Assumption of Risk: You acknowledge that any reliance on the information provided on this platform is at your own sole risk. ShakTide assumes no liability for the misinterpretation or misuse of educational materials.
  • Emergency Situations: In the event of a medical emergency, severe pain, or abnormalities, you must contact emergency services or a qualified healthcare professional immediately. Never disregard professional medical advice or delay seeking it because of something you have read on ShakTide.

Acceptable Use & Conduct

We are building a stigma-free zone for women across India. Your license to use this platform is strictly contingent upon your adherence to these rules.

  • Zero Tolerance for Abuse: Harassment, hate speech, bullying, or intimidation of our volunteers, partner doctors, or other users will result in an immediate, irrevocable ban.
  • Prohibited Activities: Automated access, deploying bots, scraping user data, or attempting to breach our authentication systems (Supabase) is strictly illegal and will be reported to authorities.
  • Account Security & Liability: You are entirely responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. ShakTide will not be liable for any losses caused by any unauthorized use of your account.

Proprietary Rights & Restrictions

The ShakTide brand, our proprietary curriculum, and our underlying software (including the in-development LLM) are heavily protected intellectual property.

  • Limited License: We grant you a limited, non-exclusive, non-transferable license to access our educational content for personal, non-commercial use.
  • No Reverse Engineering: You may not reverse engineer, decompile, or disassemble any aspect of the ShakTide platform or AI models, nor attempt to discover the source code or underlying algorithms.
  • Commercial Scraping Ban: Scraping, copying, or reproducing our platform's data, research summaries, or workshop materials for commercial gain, unauthorized API training, or competitive purposes is strictly prohibited and subject to legal prosecution under Indian copyright laws.

Indemnification & Limitation of Liability

The standard legal shield to ensure we can keep operating safely.

Indemnification: You agree to defend, indemnify, and hold harmless ShakTide, its founders, officers, directors, volunteers, and partnering medical professionals from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Platform.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHAKTIDE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE PLATFORM, OR SERVICES OBTAINED THROUGH THE PLATFORM, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

Governing Law & Dispute Resolution

Which laws govern this agreement?
These Terms of Service and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of the Republic of India without giving effect to any choice or conflict of law provision or rule.
How are disputes resolved?
Arbitration: Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Platform shall be instituted exclusively in the competent courts located in Patna, Bihar, India. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Severability & Waiver
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. No waiver by ShakTide of any term or condition shall be deemed a further or continuing waiver of such term or condition.
